1. All bookings are accepted on these terms and conditions and no variation thereof shall be valid unless same is in writing signed by both parties.

2. Upon acceptance of the booking a minimum non-refundable booking fee of 20% of estimated total cost shall be paid. Until such booking fee is paid, without prejudice to the validity of any other part of this contract, the company shall be under no obligation to perform any work.

3. The balance of the cost shall normally be paid in 3 stages and in default thereof all liability on the part of the company shall cease and the company at their absolute discretion shall be at liberty to retain the deposit and any payments received up to that point in full or in part. On completion of planned filming a further 40% of estimated total cost shall be paid, followed by a further 40% of estimated total cost on approval of the edit master. Any additional costs incurred shall be paid prior to delivery of the final product.

4. In the event of the cameraman being unable to perform or complete the engagement for any reason whatsoever the company will use their best endeavours to secure a replacement cameraman but if no such replacement cameraman can be found then the total liability of the company is limited to making a refund of all moneys paid under the agreement less any out of pocket expenses reasonably incurred.

5. Whilst every effort is made to ensure that all the equipment is in sound working order the company's total liability in the event of the cameraman being unable to perform or complete the engagement due to malfunction of equipment shall be limited to making a refund of all moneys paid under the agreement less any out of pocket expenses reasonably incurred, save that in the event of part only of the event being recorded then a proportionate amount of moneys received will be returned.

6. Whilst the cameraman will use his/her best endeavours to record the significant parts of the event or function, the contents of the recording shall be in the absolute discretion of the cameraman who gives no undertaking to successfully record any particular event and the failure on the part of the cameraman to record any particular part of the whole event or function shall in no circumstances absolve the customer from his/her liability for payment hereunder.

7. In no circumstances does the company accept liability whatsoever for any loss and/or damage consequential upon or arising out of the cameraman's failure to perform or complete the engagement for any reason whatsoever; the risk whereof the client agrees to accept by payment of any moneys due hereunder.

8. When filming has been carried out by the company, the master tape remains the property of the company and the copyright thereof belongs to them. The company reserves the specific right to dispose of same as they see fit and in their absolute discretion. No liability is accepted arising out of the loss of and/or damage to the master tape or consequential thereupon; the risk whereof the client agrees to accept by payment of any moneys due hereunder.

9. In the event of the retail price index rising above 10 per cent between the booking and the task the company reserves the right to increase the agreed price by 1 per cent for each such percentage rise.

10. In the event of cancellation by the client prior to 90 days of the date of the event then only the deposit will be forfeit. In the event of cancellation by the client between 90 days and 30 days of the date of the event a sum amounting to 50 per cent of the total agreed price shall be paid. If the cancellation occurs within 30 days of the said date then 95 per cent of the total agreed price shall be paid. Any cancellation must be notified in writing to the company's address.

11. No copies shall be made of any tapes supplied without the prior consent of the company. Unauthorised copying shall constitute a breach of copyright for which the customer will be liable in damages

12. Payment of any moneys hereunder is deemed to constitute acceptance of the terms and conditions hereof.

13. Any variation of any terms hereof whether written or oral shall not have the effect of varying or invalidating any of the other terms hereof.

14. The expression herein "the company" means "DSC Media " or their nominated agent.

15. Prices are based on events taking place within a 30 mile radius of the company's base at Milton Keynes, travel beyond that radius will be charged at 50p per mile.

16. Any requests for changes or additions to coverage must be submitted to the company in writing, 3 weeks prior to the event.

17. Any complaints must be notified to the company in writing within 28 days of receiving the completed video.

18. Nothing in these terms and conditions shall affect the statutory rights of any consumer.
